Privacy Policy

This Privacy Policy explains how Elevate Arts, LLC (“Elevate Arts,” “Proxigenta,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information in connection with the proxigenta website at www.proxigenta.com (the “Site”), the web application at app.proxigenta.com (the “App”), and the proxigenta desktop agent (the “Agent”) (together, the “Service”). It is part of, and should be read together with, our Terms of Service.

In plain terms: proxigenta is built to collect as little as possible. We use your information to monitor whether your device is online and to notify the contacts you choose when it appears to go offline. We do not sell your personal information, and we never see your precise location, and we do not collect Wi-Fi network names or ISP details.

1. Information We Collect

a. Information you provide

  • Account information. Your name and email address, used to create your account, sign you in, and send Service messages.
  • Contacts. The name and email address of each person you add as a contact to be notified during an outage. You provide this information about other people; see Section 6, which also describes the confirmation (explicit opt-in) step and the consent details we record.
  • Message content. The subject lines, message text, and recipient choices you configure for outage and status notifications.
  • Settings. Your preferences, such as outage thresholds, grace periods, per-message alert timing, online-hours schedule and time zone, scheduled time-away windows and holiday calendars, and Ghost mode state.
  • Support and communications. Information you provide when you contact us for support or otherwise communicate with us.
  • Notifications. If you enable notifications, we store a push subscription for that browser or device (an endpoint and keys provided by your browser's push service) so we can deliver your own outage alerts. When an outage check-in notification arrives, the App may automatically confirm receipt so the Service can tell whether that device was reachable; if you enable the optional faster-escalation setting, an unreachable device only speeds up your alert schedule and never suppresses alerts. The subscription is used only for these purposes, and you can turn it off anytime.
  • Activity history. A log of Service events on your account, such as outages detected, alerts sent and to whom, acknowledgements, recoveries, and changes to your devices and contacts. This history is shown to you in the App and is deleted automatically after 90 days.
  • Region (optional). If you choose to enter a coarse region (for example, a city), we store it to check public outage and disaster feeds (such as the U.S. National Weather Service, USGS, GDACS, IODA, and Cloudflare Radar) when an outage is detected; those queries include only your coarse region, so your alerts can note when public monitors report a regional event that may be affecting your area. It is self-declared and stored only as an approximate area; we never derive your location from your IP address, and you can clear it at any time. If you enable optional automatic updates, the Agent reads your device's location and rounds it to an approximate area (about 10 km) on your device before sending; your precise location never leaves your device.

b. Information from the desktop agent

When you install and run the Agent, it periodically checks in with our servers. In doing so we receive a device identifier (derived from your computer's hardware identifier), a device name (such as your computer's name), and the time of each check-in, which we use to determine your online/offline status. The Agent does not collect Wi-Fi network names (SSIDs), browsing activity, files, or the contents of your screen, and it does not collect your location unless you enable optional automatic region updates, which send only a coarse area rounded on your device, as described above. We also receive the network (internet, or “IP”) address that each check-in is sent from. We keep the most recent one with your device record and note it in your activity history when it changes, so that a check-in arriving from an unexpected network, for example if your device’s credential were copied and used elsewhere, is visible to you as a possible security signal. We use this only to operate and secure the Service; it never triggers a contact alert, and we do not use it to determine your physical location.

The Agent also reports your device's battery level and power state (whether it is running on battery or external power, and whether it is charging), along with basic sleep and shutdown events. We use this only to improve the accuracy of outage alerts, for example to stay silent when your device is simply asleep or has run out of battery, and we never share it with your contacts.

If you turn on optional calendar sharing, the Agent also sends the times of upcoming busy blocks from your calendar for roughly the next 48 hours, together with the number of attendees. It never sends event titles, notes, locations, or participant names or email addresses, and solo events are excluded. We use this only to time or gate your own outage alerts (for example, alerting only when a meeting is coming up), we never share it with your contacts, and you can turn it off at any time, which stops the Agent from reading your calendar.

c. Information collected automatically

Like most online services, our infrastructure records limited technical information needed to operate and secure the Service, such as event logs (for example, sign-ins, device check-ins, and notifications sent), timestamps, and error logs. We and our hosting and email providers process network (internet, or “IP”) addresses and standard connection metadata to route traffic, deliver email, secure the Service, and protect against abuse. In particular, we use the network address a request arrives from to enforce rate limits that guard against abuse, and, as described in Section 1(b), we retain the address your device most recently checked in from so that a check-in from an unexpected network can be surfaced to you. We do not use your IP address to infer or track your physical location.

d. Payment information

If you purchase a paid plan, payment is processed by our payment provider and Merchant of Record, Lemon Squeezy. We do not receive or store your full payment card number. We receive limited billing information such as your subscription status, plan, renewal and expiration dates, and the card brand and last four digits, which we use to manage your subscription.

2. How We Use Information

We use personal information to:

  • provide, operate, and maintain the Service, including monitoring device status and sending check-in and outage notifications;
  • authenticate you and secure your account using passwordless, single-use sign-in links and session cookies;
  • deliver notifications to the contacts you designate, on your behalf;
  • process payments and manage subscriptions through our payment provider;
  • respond to your requests and provide customer support;
  • monitor, troubleshoot, secure, and improve the Service and prevent abuse; and
  • comply with legal obligations and enforce our Terms.

3. How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only as described below:

  • With your contacts, on your behalf. When you go offline and do not cancel in time, we send your designated contacts the notifications you configured. Those messages may include your name and message content you chose.
  • Service providers (sub-processors). We use trusted third parties to run the Service, including Google Cloud (hosting, database, and task processing), SendGrid (a Twilio company) for email delivery, and Lemon Squeezy for payments. Additional providers, such as SMS or messaging vendors, may be added for future features. These providers process information on our behalf under contractual obligations.
  • Your status page, if you enable it. You can turn on an optional status page and share its link. Anyone with the link sees a single indicator: whether an outage is currently detected. It shows no history, no schedule, and no other details, it is excluded from search engines, and you can retire the link at any time, which disables it immediately.
  • Integrations you configure. If you set up an outbound webhook, we send outage-related events for your account (such as outage detected, contacts alerted, acknowledgements, and recovery) to the destination URL you choose. Choose destinations you trust; once delivered, that data is handled under the destination’s own policies.
  • Legal and safety. We may disclose information if required by law or legal process, or to protect the rights, property, or safety of proxigenta, our users, or others.
  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
  • With your consent. We may share information for other purposes with your consent.

4. Cookies and Similar Technologies

The App uses a single essential, signed session cookie to keep you signed in after you click a sign-in link; it is set to be HTTP-only and is not used for advertising or cross-site tracking. We do not use advertising or analytics cookies to track you across other websites. The public Site is hosted on Webflow and may use strictly necessary cookies; third-party scripts on the Site or checkout, such as our payment provider's, may set their own cookies governed by their privacy policies. You can control cookies through your browser settings, though disabling the session cookie will prevent you from staying signed in.

5. Legal Bases for Processing

Where the EU/UK General Data Protection Regulation applies, we process personal information on the following legal bases: to perform our contract with you (to provide the Service); our legitimate interests (to secure, operate, and improve the Service and prevent abuse); your consent (where required, such as for certain communications); and to comply with legal obligations.

6. Your Contacts' Information

proxigenta lets you add contacts so we can notify them on your behalf, using an explicit opt-in process. When you add a contact, we present that person with a confirmation request that discloses who added them, what they will receive (outage and absence alerts only), the expected frequency, our mailing address, and a link to this Policy. We do not send any alert to a contact until they have confirmed their consent, and a contact who does not confirm is never contacted. When a contact confirms, we record consent details as proof of opt-in, including the date and time, the internet (IP) address used to confirm, and the version of the disclosure shown. We act on your behalf to deliver the notifications you configure; we do not use your contacts' information to market to them or for any unrelated purpose. Every message we send a contact includes a one-click unsubscribe link, and our email provider adds standard list-unsubscribe options as well. If a contact unsubscribes or reports a message as spam, we update their status and stop sending to them; we honor those signals automatically and do not re-mail a contact who has opted out. If a contact’s address bounces, we record a delivery issue and surface it to you in the App so you can correct the address; the contact remains configured, and delivery may be attempted for future alerts unless they opt out or you remove them. You can also remove any contact at any time in the App, and you remain responsible for having a proper basis to add each contact, as described in our Terms of Service.

7. Data Retention

We keep personal information for as long as your account is active or as needed to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. When you delete your account or ask us to delete your information, we will delete or de-identify it within a reasonable period, except where retention is required by law or for legitimate business purposes such as security and fraud prevention. Operational logs are kept for a limited period. The network address your device most recently checked in from is kept with your device record while that device is enrolled and is cleared when you remove the device or delete your account; entries in your activity history, including any note that your device’s check-in network changed, are deleted automatically after 90 days.

8. Security

We take reasonable technical and organizational measures to protect personal information. These include encryption of data in transit (HTTPS/TLS), storing API keys and sign-in tokens only in hashed form, signed and HTTP-only session cookies, restricting administrative access, keeping secrets in a managed secrets vault, and using authenticated email (SPF, DKIM, and DMARC) to reduce spoofing. We also verify that updates to the Agent carry a valid cryptographic signature before they are applied, pin our server software to specific reviewed dependency versions, and apply content-security, request-validation, and rate-limiting protections to defend against abuse. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

9. International Data Transfers

We are based in the United States and use service providers that may store and process information in the United States and other countries. If you access the Service from outside the United States, you understand that your information may be transferred to, stored, and processed in countries whose data-protection laws may differ from those of your country. Where required, we rely on appropriate safeguards for such transfers.

10. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information, including the rights to access, correct, delete, or receive a copy of it, to restrict or object to certain processing, and to withdraw consent. You can view and update much of your information, including your contacts, messages, and settings, directly in the App, where you can also download a copy of your data or delete your account. To exercise other rights, contact us using the details below. We will not discriminate against you for exercising your rights.

California residents (CCPA/CPRA). We do not sell or share personal information as those terms are defined under California law. You may request access to, or deletion of, your personal information, and you may designate an authorized agent to act on your behalf. We will verify your request before responding.

EU/UK residents (GDPR). You may also have the right to lodge a complaint with your local data-protection authority.

11. Children's Privacy

The Service is intended for adults and is not directed to children under 18. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us and we will take steps to delete it.

12. Third-Party Links and Services

The Site or App may link to third-party websites or rely on third-party services that we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy policies.

13. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice, such as by posting the updated Policy on the Site and updating the effective date above. Changes are effective when posted unless stated otherwise.
